Delivering material disclosures

Communicate important facts, known defects, say, explicitly, and prove acknowledgement version-exact, instead of leaving them in a folder.

Step by step

  1. Record the disclosure in the sales area and rate its significance.Drafts stay editable

The result: For every disclosure it is provable which wording was delivered when, and when it was acknowledged.

Important: ImmoDok documents the communication. Whether a fact must be disclosed is a legal question; when in doubt it belongs with a lawyer. Whether a disclosure satisfies the duty to inform depends on the individual case (BGH, judgment of 15 September 2023, V ZR 77/22): documents in the data room count only if the seller may expect the buyer to take note of them. Important defects should additionally be communicated explicitly.

What if it does not work?

The buyer's order is blocked.
There are published disclosures without confirmed acknowledgement. That is intentional: read and confirm first, then order.
