§ 548 BGB deadline calculator: claims after moving out
Under § 548 BGB, claims after moving out become time-barred after six months: the landlord's from the return of the flat (subsection 1), the tenant's from the end of the tenancy (subsection 2). The calculator names the last day.
Landlord's claims
Damage to the flat: the period starts when the flat is returned (§ 548 (1) BGB).
Tenant's claims
Reimbursement of expenses and removal of fittings: the period starts when the tenancy ends (§ 548 (2) BGB).
- Negotiations about the claim suspend the limitation period (§ 203 BGB), as do e.g. a lawsuit or independent evidence proceedings (§ 204 BGB); the calculator does not account for that.
- Repayment of the deposit itself is not subject to this six-month period.
- Public holidays are not counted in; if the end falls on a holiday, the next working day applies as well.
